If a prisoner dies while in transit and before he can be received in any prison en route, the officer in charge of the police escort shall report the fact to the Superintendent from where he was dispatched. The Superintendent in turn shall immediately inform the District and Sessions Judge of the district where the death has taken place for the institution of inquest proceedings by a Judicial Magistrate as per Section 176 of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974). The Superintendent of the transferring prison shall also inform the deceased prisoner's relatives, the State Government, and the National and State Human Rights Commission of the death of the prisoner, as per law. If an escape occurs in route, an intimation of the same shall be given as soon as possible to the nearest police control room on the police emergency helpline number with a view to ensure his re- capture. The Superintendent of the prison from where the prisoner came and the Superintendent of the receiving prison who was to receive him, shall also be informed.
