No prisoner shall receive ordinary remission for the calendar month in which he is going to be released: Provided that Annual Good Conduct Remission (AGCR) may be granted to a prisoner whenever it is due. Provided further that if on calculating the final date of release, it is found that the grant of the full amount of remission for any month would bring the prisoner’s date of release within the very month, remission just sufficient to release him on the last day of the month shall be given. Illustration.- A prisoner is working as convict officer and he is due for release on 3rd July without giving ordinary remission for the month of June. If ordinary remission of 5 days for the month of June is awarded to him, his final date of release will be 28th June. In such scenario, ordinary remission of 3 days for the month of June shall be given and he shall be released in the evening on 30th June. Remission to prisoners convicted from other States.
