Whoever, not being authorised to collect information under the provisions of this Act, by words, conduct or demeanour pretends that he is authorised to do so, shall be punishable with imprisonment for a term which may extend to three years and with a fine which may extend to one lakh rupees or, in the case of a company, every person who at the time the offence was committed was in charge of and was responsible to the company for the conduct of the business of the company, with imprisonment for a term which may extend to three years with a fine which may extend to ten lakh rupees or with both.
