Where any infrastructure development work has been provided or is under the control and management of the Authority, the Chief Executive Officer may require the local authority, within whose local limits such infrastructure development work is situated, to assume the responsibility for the maintenance of such infrastructure development work, on such terms and conditions, as may be agreed upon between the Authority and that local authority: Provided that where such terms and conditions have not been agreed upon, the Chief Executive Officer shall make, in consultation with the Commissioner or Executive Officer of the local authority concerned, a statement on the difference in opinion on the specific terms and conditions and submit such statement to the State Government for a decision and the decision of the State Government shall be final and binding on the Authority and the local authority.
