Section 33

Control of State Government over Board

Control of State Government over Board. - (1) The State Government shall exercise superintendence and control over the Board and its officers and may call for such information as it may deem necessary and, in the event of its being satisfied that the Board is not functioning properly or is abusing its powers. It may, by notification supersede the Board : Provided that before superseding the Board of State Government shall give a reasonable opportunity to the Board for showing cause against the proposed supersession : Provided further that the Board shall be reconstituted, within a period of one year, from the date of its supersession. (2) When the Board is superseded under sub-section (1), the following consequence shall ensue, namely :- (a) all members of the Board including the Chairman shall, from the date of the notification, vacate their offices; (b) all powers, duties and functions of the Board shall, during the period of supersession, be exercised and performed by such person (to be called the administrator) as may be appointed by the State Government: Provided that the administrator may, subject to the approval of the State Government, delegate any of his powers, duties or functions to any other person as he may think fit; (c) all assets and liabilities of the Board shall, until it is reconstituted, vest in the State Government.
