(1) Except in the case of the constitution of the Council for the first tune, the term of office of a member of the Council, other than the ex-officio member, whether elected or nominated, shall be a period of five years commencing on Constitution and incorporation of Council. (2) The term of an outgoing member shall, notwithstanding anything contained in sub-section (5) of section 3 and sub-section (7) of this section, be deemed to extend to, and expire with, the day immediately preceding the day on which the name of the successor of such member is published under sub- section (6) of section 3. (3) An outgoing member shall be eligible for re-election or re-nomination.
