Members of the Home Guards acting under this Act shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code. 30[9A. (1) A member of the Home Guards shall not be disqualified for being chosen as, and for being, a member of the 31[Gujarat Legislative Assembly] merely by reason of the fact that he is a member of the Home Guards. (2) Notwithstanding anything contained to the contrary in any other law for the time being in force, a member of the Home Guards shall not be disqualified for being chosen as, and for being, a member of any local authority merely by reason of the fact that he is a member of the Home Guards ].
