Section 261

Appointment of executor by court

Appointment of executor by court.— The court may appoint an executor when the heirs do not agree on the choice of the executor. Where there are minors, interdicted or absent heirs, any interested party may apply to the court that an executor be appointed. The applicant shall disclose who are the other interested parties and he may propose the person who in his view is best qualified for being appointed as an executor.
