Tampered or torn will.— Where the will is found open and tampered with, or torn, the following provisions shall apply:- (a) Where the will is found cancelled and obliterated, or torn, either amidst the effects of the testator or in the possession of a third party, to such an extent that it is not possible to read the original disposition, it shall be deemed to be non-existent; (b) Where it is proved that any person other than the testator has tampered with the will, the provisions of sections 239 and 240 which are applicable to a person who fraudulently withholds or removes the will shall be applicable to such person.
