Exclusion of right of accretion.— (1) The legatees shall not have the right of accretion interse. (2) If the bequeathed thing is indivisible or cannot be divided without detriment, the co- legatees shall have the option either to retain the whole thing against payment to the heirs of the value of the excess or to receive from them whatever as of right belongs to them, delivering to such heirs the bequeathed thing. However, when the legacy is encumbered with an obligation and the said obligation lapses, the legatee shall profit from the resulting benefit, if the testator has not provided the contrary.
