Cognizance and trial of offences.— (1) No prosecution for an offence under this Chapter shall be instituted except by or with the written consent of the officer appointed by the Government or by a person authorized in this behalf, by general or special order, by the Government. (2) No Court inferior to that of the Judicial Magistrate of the First Class shall try offences under this Chapter. (3) Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (Central Act 2 of 1974), an offence punishable under this Chapter shall be cognizable and non-bailable.
