Surrender by mundkar.— (1) Any mundkar may surrender his right over the dwelling house if the following conditions are satisfied:— (i) it is made by the mundkar in writing and is admitted by him before the Mamlatdar; (ii) it is made voluntarily and in good faith to the satisfaction of the Mamlatdar; (iii) it is approved by the Mamlatdar. -----8----- (2) Where the Mamlatdar is of the opinion that the conditions mentioned in sub-section (1) are not satisfied, he may, after giving a reasonable opportunity to the bhatkar to show cause against taking action under this sub-section, and after holding such inquiry as he may deem fit, by order, refuse to approve the surrender.
