Procedure where plaint admissible.— (1) Where a plaint is admissible, the Mamlatdar shall receive and file it and shall grant a receipt in the prescribed form. He shall as soon as may be thereafter fix a day and place for the trial of the case, and shall issue, at the expense of the plaintiff, notice in the prescribed form to the defendant. He shall then require the plaintiff to appear with his documents, if any, and witnesses if any, on the day and at the place fixed. (2) The date to be fixed for the trial of the case shall not be later than fifteen days from the day on which the notice is issued, except for sufficient reason to be recorded in writing by the Mamlatdar with his own hand. (3) The place to be fixed for the trial of the case may be in the Mamlatdar‟s office, or at or near the scene of dispute or at any other spot that the Mamlatdar considers convenient to the parties.
