Penalty.— (1) Notwithstanding anything to the contrary contained in any other law for the time being in force, whoever contravenes the provisions of section 4 shall, on conviction, be punished with imprisonment which may extend to2[three years or with fine which may extend to Rs. 50,000/- or with both] (2) An offence under this section shall be cognizable. 3[(3) If any authority as mentioned in sub-section (1) of section 6, after receiving the information of any contravention of the provisions of this Act, without sufficient cause fails or neglects to take any action as provided in this Act within such period as may be specified by the Government by notification in the Official Gazette, the officer in charge of such authority shall be liable to a fine of Rs. 50/- per day of delay in taking such action, subject to a maximum of Rs. 5000/-, upon conviction by the Judicial Magistrate First Class, after a complaint in that regard is filed by the Government. Explanation: —(1) “Complaint” as mentioned in this sub-section shall be filed by the concerned Administrative Secretary of the Government or by such officer as may be authorized by the Government in this behalf: Provided that nothing in this sub-section shall prevent the concerned disciplinary authority from initiating disciplinary proceedings against such officer for such failure or neglect. (4) Notwithstanding anything contained in sub-section (3), it shall be mandatory for the authority mentioned in sub-section (1) of section 6 to take action as provided in this Act.]
