Offences under this Act to be cognizable.— (1) Any offence punishable under this Act shall be cognizable offence within the meaning of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974). (2) No court shall take cognizance of any offence punishable under this Act, except upon a complaint in writing by the Ground Water Officer or an Officer generally or specially authorised by the Government in this behalf.
