Section 18

Procedure for taking possession

Procedure for taking possession.— (1) A tenant entitled to possession of any land or dwelling house under any of the provisions of this Act may apply in writing for such possession to the 65[Mamlatdar]. The application shall be made in such form and within such period as may be prescribed by or under this Act. (2) No landlord shall obtain possession of any land or dwelling house held by a tenant except under an order of the 66 [Mamlatdar], for which he shall make an application in such form and within such period as may be prescribed by or under this Act. (3) On receipt of an application under sub-section (1) or (2) the 67 [Mamlatdar]shall, after holding an enquiry, pass such orders thereon as he deems fit, with due regard to the other provisions of this Act and the Rules. (4) Any tenant or landlord taking possession of any land or dwelling house except in accordance with the provisions of sub-section (1) or (2), shall be liable to forfeiture of crops, if any, grown in the land in favour of the landlord or the tenant, as the case may be, in addition to payment of such costs as may be awarded by the 68[Mamlatdar] or by the 69[Collector] on appeal and also to the penalty, if any, prescribed by or under this Act. (5) The Government may, by notification, direct that the provisions of the foregoing sub- sections shall apply to sites used for allied pursuits as they apply to sites of dwelling houses of an agriculturist and thereupon the provisions shall so apply. 70[“CHAPTER IIA Special rights and privileges of tenants
