Bill-sticking without permission.— 36 (1) Whoever, without the consent of the owner or occupier or other person for the time being in charge affixes or causes to be affixed any poster, bill, notice, placard or other paper or means of advertisement against or upon any street, building, wall, tree, board, fence or pole or writes upon, soils, defaces or marks any such building, wall, tree, board, fence or pole with chalk or paint or in any other way whatsoever, shall be punishable with fine which may extend to one thousand rupees. [(1) Whoever, without the consent of the owner or occupier or other person for the time being in charge affixes or causes to be affixed any poster, bill, notice, placard or other paper or means of advertisement against or upon any street, building, wall, tree, board, fence or pole or writes upon, soils, defaces or marks any such building, wall, tree, board, fence or pole with chalk or paint or in any other way whatsoever, shall be liable to a penalty which may extend to ten thousand rupees.] (2) Notwithstanding anything contained in section 351, a Court may take cognizance of an offence under sub-section (1) of this section upon the complaint of' the owner or occupier or other person in charge of the property in respect of which such offence is alleged to have been committed.
