Power of Commissioner to stop progress of building work unlawfully commenced or carried on. — (1) In any case in which the erection of a building has been commenced or is being carried on unlawfully as mentioned in section 269, the Commissioner may by written notice require the building operations to be discontinued from the date of service of such notice. 32 (2) Any person failing to comply with the term of such notice shall be punishable with a fine which may extend to ten thousand rupees and if he fails to comply with the --107-- terms of such notice after the first day of his failure so to do, with a further fine which may extend to one thousand rupees for every such day after the first. [(2) Any person failing to comply with the terms of such notice shall be liable to a penalty not exceeding one lakh rupees; and if he continues to fail to comply with the terms of such notice after the first day of such failure, he shall be liable to a further penalty not exceeding ten thousand rupees for every day thereafter during which the failure continues.]
