Constitution of Tribunal of Appeal.— (1) The Government shall, for the purpose of hearing and deciding appeals under sub-section (2) of section 71, appoint a Tribunal of Appeal (hereinafter referred to as the Tribunal). (2) The Tribunal shall consist of a Chairman and two assessors. (3) The Chairman shall be the District Judge or such other Civil Judge as may be appointed by the Government on the recommendation of the District Judge. (4) The Chairman shall appoint suitable persons as assessors who shall, as far as possible, have knowledge or experience in town and country planning, valuation of land or civil engineering. (5) The Chairman may remove any assessor appointed under sub-section (4) from his office on the ground of incompetence or misconduct or for any other good and sufficient reason: Provided that no assessor shall be removed from his office except after giving him a reasonable opportunity of being heard. (6) If any assessor is removed from his office or dies or refuses or neglects to act, or becomes incapable of acting, as such assessor, the Chairman shall appoint another person as assessor under sub-section (4).
