Private markets, etc., not to be held without licence.— No person shall use or allow to be used any place in any municipal area — (i) as a private market; or (ii) as a private slaughter-house; or (iii) for the storage or sale of flesh or fish or animals or birds intended for human food, except under and in accordance with the conditions of a licence granted in accordance with the provisions of the bye-laws made in this behalf: Provided that no licence under this section shall be required for selling or storing of flesh or fish contained in hermatically sealed receptacles. (2) Whoever uses or allows to be used any place for any of the purposes specified in sub-section (1), without a licence, or in contravention of any conditions subject to which a licence may have been granted under sub-section (1) shall, on conviction, be punished with fine which may extend to 396 [five thousand rupees] if the contravention is of clause (i) or (ii) of sub-section (1) and with fine which may extend to 397[one thousand rupees] if the contravention is of clause (iii) of that sub-section, and in the case of continuing contravention of the said clause (i) or (ii) with further fine of 398 [one hundred rupees], and of the said clause (iii) with further fine of 399 [fifty rupees], for every day after the first during which such contravention continues.
