Roofs and external walls of buildings not to be made of inflammable materials.— (1) The external roofs and walls of buildings constructed or renewed after the appointed day, shall not be made of grass, wood, cloth, canvas, leaves, mats or other inflammable material, except with the written permission of the Chief Officer, which may be given either specially in individual cases, or generally in respect of any area specified therein. (2) The Council may by bye-laws prescribe— (i) the areas in which permission shall be granted by the Chief Officer for the construction of external roofs and walls of buildings from any inflammable material; (ii) the conditions which may be imposed by the Chief Officer in granting permission for such construction in any other area. Manual of Goa Laws (Vol. III) – 378 – Municipality Act (3) The Chief Officer may at any time by written notice require the owner of any building which has an external roof or wall made of any such material as aforesaid, to remove such roof or wall within such reasonable time as shall be specified in the notice, whether such roof or wall was or was not made before the appointed day and whether it was made with or without the permission of the Chief Officer. (4) An appeal shall lie to the Council against any order of the Chief Officer refusing the permission under sub-section (1) or against any notice given by the Chief Officer under sub-section (3), if made within fifteen days of the receipt of such refusal or notice, as the case may be. (5) Whoever without such permission as is required by sub-section (1), makes or causes to be made, or in disobedience to the requirements of a notice given under sub- section (2) suffers to remain, any roof or wall of such material as aforesaid, shall, on conviction, be punished with fine which may extend to 352[five thousand rupees], and in the case of a continuing offence with further fine which may extend to 353[one hundred rupees] for every day after the first during which such offence continues.
