Procedure in other cases. (1) In any case not covered by Sec. 83 or 84 the Commissioner or the Magistrate concerned, as the case may be, shall issue a proclamation specifying the articles of which such property consists and requiring any person who may have a claim thereto to appear before himself or some other officer whom he appoints in this behalf and establish his claim within six months from the date of such proclamation. 1 These words were substituted for the words “In Greater Bombay” by Bom 56 of 1959, Sec. 3, Schedule. 2 These words were substituted for the words “'In areas outside Greater Bombay” by Bom 55 of 1959, Sec. 8, Schedule. 3 These words and figures were inserted by Bom 34 of 1959, Sec. 27. 50 (2) Power to sell perishable property at once. If the property, or any part thereof, is subject to speedy and natural decay, or consists of live-slock, or if the property appears to be of less value than five rupees, it may be forthwith sold by auction under the orders of the Commissioner, or the Magistrate concerned, as the case may be, and the net proceeds of such sale shall he dealt with in the same manner as is hereinafter provided for the said property. Gujarat Amendment: In the principal Act, in Sec. 85,- (1) in sub-section (1), for the portion beginning with the words “to appear before” and ending with the words “of such proclamation”, the following shall be substituted, namely :- "to appear before himself or some other officer whom he appoints in this behalf within three months from the date of such proclamation and establish his claim within a period not exceeding three months after such appearance: Provided that the Commissioner, the Magistrate or the concerned Officer, may, in any appropriate case, for reasons to be recorded in writing, extend the said period of three months for establishment of the claim by such further period and subject to such conditions as he may deem fit." (2) in sub-section (2), for the words “five rupees”, the words “fifty rupees” shall be substituted.1
