Offences under this Act to be cognizable and bailable. - (1) An offence under this Act or any rule, order or direction made or issued thereunder shall be cognizable and bailable. (2) No Court shall take cognizance of any offence punishable under this Act or any rule, order or direction made or issued thereunder except on a report in writing of the facts constituting such offence made by a police or excise officer not below the rank of sub-inspector or any other officer empowered in this behalf by the Controller.
