Cognizance of offences

No Court shall take cognizance of an offence under section 77, except on the complaint of,-- (a) in the case of an offence relating to section 4, by an officer of the Authority authorized in that behalf by the Authority; (b) in the case of any other offence,-- (i) where a Board is constituted, by an officer of the Board authorized by the Board in that behalf; (ii) where no Board is constituted, by an officer of the State Government authorised by the State Government in that behalf.] Subs. by Act 101 of 1956, sec. 21, for section 77C (w.e.f. 30/12/1956).
