Cognizance of offences.-(1) No Court inferior to that of a Magistrate of the second class shall try any offence under this Act. 2["(2) Every offence under this Act, except the offence under sub-section (1) (c) of Section 45 shall, for the purpose of the Code of Criminal Procedure, 1973 (2 of 197 4) be deemed to be a cognizable offence." (3) No prosecution for an offence under this Act shall be instituted without the previous sanction of the Registrar, and the Registrar shall not sanction the prosecution of any person unless he has given such person an opportunity of being heard.
