1 [36AI. Tribunal to have powers of a civil court. -- (1) The Tribunal shall have the powers of a civil court, while trying a suit, under the Code of Civil Procedure, 1908 (5 of 1908), in respect of the following matters, namely:-- (a) summoning and enforcing the attendance of any person and examining him on oath; (b) requiring the discovery and production of documents; (c) receiving evidence on affidavits; (d) issuing commissions for the examination of witnesses or documents. (2) Notwithstanding anything contained in sub-section (1) , or in any other law for the time being in force, the Tribunal shall not compel the Central Government or the Reserve Bank,-- (a) to produce any books of account or other documents which the Central Government, or the Reserve Bank, claims to be of a confidential nature; (b) to make any such books or documents part of the record of the proceedings before the Tribunal; or (c) to give inspection of any such books or documents to any party before it or to any other person.]
