Disqualifies- H*- No Person shall be elected or co-opted and remain tions: as President, Vice-President or Member of Zilla Parisbad, Anchaiik Par.chayat and Gaon Panchayat, if be or she — (a) has been convicted of an offence involving moral turpitude or ordered to give security for good behaviour under Section 110 of the Cote of Criminal Procedure, 1973, unless a period of four years has lapsed on ' e date fixed for holding election from the date of his release in case of a sentence or imprisonment and in case of sentence other than imprisonment from the da*e of conviction; or (b) has been dismissed from Government service for commission of act involving moral turpitude unless a period of five years has elapsed on the date fixed for holding election from the date of his dismissal; or (c) applies to be declared as an uncertified bankrupt or undis­ charged insolvent; (d) has been proclaimed a tout under the Legal Practitioners Acts or (e) holds any service, of profit under Government (or any edu­ cational institution rec.gni'ed and receiving grant from the Govern meat; or holds remunerated office under Zilla Parishad, Anchaiik Panchayat and Gaon Panchayat or holds any contract under any of the aforesaid bodies or under the Government ; or (f) has been during the four years immediately preceding the date of election convicted of an offence punishable under Section 135, or clause (a) or sub-section (2) of Section 136 of the Representa­ tion of PeotleS Act., 1951 cr has teen found by a competent autho­ rity to have resorted to corrupt p . dice resulting in selling aside of his election to any local body or to any legislature in India ; or ■V (g) has been a defaul er of pavment of any rate, tax cess or fee imposed under »he provisions of this Act and the Rules framed hereunder or of any loan of cooperative society; <*jr . jt *Sp (h) if any question arises as tc whether a member of a Pancha yat body at any level has become subject to any of the disqualifications under this section, the question shall be referred for decision of such authority and in such manner as the Government may by law provide ; THE ASSAM GAZETTE, EXTRAORDINARY, MAY 6, 1994 673 (i) if a person who is chosen a a member of a Pai.cha,at is or been • es taembir o the Eous- of he People, the State Legislative A ssmoly or is or becomes a Municipal Councillor or a Councillor ot a u< i ipal rpMation or a member, of a Town Committee, then vithin fifteen ay from the cate of commeneemest of the term r ofbce of a n e ter <f the H iiSe of People, he State Legislative Assem­ bly or of Municipal Corporation or C -ncillor of Municipality or m tuber of Tov Committee, h s '-eat in the Panchayat shall become vacant unless he has pt viou ly resigned his seat n the H use of People, the State Legisla ive Assembly or tbe Municipality or the Municipal Corporation cr the town committer ?s the case may be ; (j) no person shall be disqualiPed on the ground that Fe is less than twentyfive years of age, if be has attained the age of eighteen years.
