Enhanced punishment for certain offences after previous conviction.- Whenever any person, having been convicted of an offence under clause (a) or clause {b) of section 5, is again convicted of an offence under either of the afore- said clauses, the imprisonment with which he shall be punished shall be rigorous imprisonment for a term which may extend to ten years t:l:[and fine]. tt[ Provided that an accused who is found on evidence to be a smuggler of opium or a seller of opium shall not receive a sentence of less than three years' rigorous imprisonment and fine. ]
