Whereas it is expedient further to amend the Assam Asam Lokayukta and U pa-Lokayuktas Act, 1985, ^ct X* here in af te r r ef erred to as the princi pal A ct, in the ° m an ner here-in- after a pp earing ; It is here by en act ed in th e Fiftieth Y ear of th e Rep ub lic o f India as follows (1) This Act may be called the Assam Lokayukta and Upa-Lokayuktas (Amendment) Act, 1999. (2) It shall have the like extent as the principal Act. (3) It shall come into force at once. In the principal Act, in section 3,— (i) in sub-section (1), in clause (b), in the first paragraph, punctuation mark colon, appearing at the end, shall be omitted and thereafter the following shall be inserted, namely "provided, however, that when the office of the Lokayukta is vacant the Upa-L okayukta or Upa-L okayuktas shall be appointed following the same procedure as provided at clause (a) for appointment o f the Lokayukta." ; (ii) in sub-section (3),— (a) after the first paragraph, the following proviso shall be inserted, namely "Provided tha t in the event of the office of the Lokayukta falls vacant the duties of the offic e of the Lokayukta shall be performed by the Up a-Lokayukta or Upa-Lokayuktas untill the Lokayukta appointed under section 3 enters upon his office ; (b) in the existin g prov iso, after the word, "Provided", the word "further" shall be inserted.
