(1) If the Medical Officer of Health or any municipal employee authorised by him in this be half, is of opinion that the cleansing or disinfecting of any building or any part of a building, or any article therein which is likely to retain infection, or of any tank, pool or well adjacent to a building, should tend to prevent or check the spread of any dangerous disease, he may cause to be cleaned or disinfected such building or part thereof, article, tank, pool or well and may by written notice, require the occupier of such building or any part thereof to vacate the same for such time as maybe specified in such notice. (2) The cost of cleansing or disinfecting any building or part thereof or any article therein under sub-section (1) shall be paid by the occupier of such building and the cost of cleansing or disinfecting any tank, pool or well, under the said sub-section, shall be paid by the person in actual possession of such tank, pool or well or if there be no such person by the owner, thereof: Provided that if, in the opinion of the Com missioner, the owner or occupier is due to poverty unable to pay the said cost, the Commis sioner may direct payment thereof to be made from the Municipal Fund.
