Notwithstanding anything to the contrary in any o?land from la w , usage or agreement, no landlord shall be entitled tenant! for to terminate the tenancy of any person on the ground personal for hi s requiring the land for his personal cultivation by tbeVand- e x c ePt u a der the following circumstances, namely :— [(a) if the aggregate area of lands in actual occu patio n of a ten ant does not exceed 10 bighas, then he shall not be ejected therefrom , until he has been provided with lan d of equivalent value in the locality : (b) if the aggregate area of lands in actual occu pation of a ten ant exceeds 10 bighas, then the tenant shall not be ejected from a minimum area of 10 bighas ’' ' ' jj Omitted by Assam Act XXVII of i960. “
