(1) No M agistrate shall take congnizance of an offence punishable - (a) under sections 53, 54, 55 or 61 except on his own knowledge or suspicion or on the com plaint or report of an Excise officer; (b) under section 56, 57, 58 or 64 except on the com plaint or report of a Collector or other officer em pow ered under sub-section (2) of Section 42 to investigate the case ; or (c) under clause (d) and (e) of section 62 except with the sanction of the District Collector. (2) except with the special sanction of the State Government, no M agistrate shall take cognizance o f any offence punishable under this A ct, unless the prosecution is instituted within six m onths after the com m ission of the offence.
