Where the State.Government is of the opinion that the company due to its negligence or otherwise. has caused loss, damage and deterioration of the assets taken over by them with the project during the period in their possession, the State Government shall be entitled ?o get the value of ~uch loss, damage and deterioration assessed by the Commission under the Act and shall be entitled to deduct the amount so assessed from the amount pay- · able to the company under this Act : Provided that before making such deduction the company shall be given a notice, not later than 12 months from the date of receipt of the assessment report from the Commission under sub-section (4) of section 14, to show cause against such deduction within .a period of fifteen days from the date of receipt of such nofice.
