(1) No offence under this Act, or any rule offences or bye-law framed thereunder shall be tried by a Court other than that of Judicial Magistrate of the First Class or a Judicial Magistrate of the Second Class, specially empowered in this behalf by the State Government. (2) Prosecution under this Act, rules or bye-laws framed thereunder may be instituted by any person duly authorised in writing by the State Government or the market committee in this behalf. 26 Admissibility
