Gratrt of uc€rsG to esublish a prlvate Darlnet - (1) No person shalt esublish and opcrirte a priv"at€ market for mar*eting of agrlcultural produce without obtalnlng a llcense under thls Act {2) Any person may -appty to the Director of Agicultural Marf(eflng for grant of a llcense to establish a prlvate market ln the State, in such form,'in such manner and with such fees, as may be prescribed. (3) Every appllcaEon made under this section shall be dtsposed of by tlre Director of Agrlanlurral Marketing wlthln a period of sixty days from the date of receipt of such applicaHon. (4) SubJect to such conditions as may be presclibed the Director of Agrlcultural Markedng may either grant a ticense ln the precrtbed nanner to the applicant for establishing a prlvate market or refuse to grant a llcense under thls section: Provided that if the Dlrector of Agricultural Marketing rcfuses to grant a llcense under this secdon, he shall record dte Feasons for such refusal in wridng and communicate hls order to the appucant (5) Every llcense granted under thts s€ctlod shall rematn valid from the date of its issue for such period as may be specified ln the license and may be renewed from time to tlhe, for such perlod on pa5ment of sudr fee, tn such manner and on fulfilment of such condltioru as may be prescribed. (61 lf the Dtrector of Agrlarltural Marketing refuses to renew a Iicense granted urdcr this sec{oq he shall record the reasons for such refusal In writing and communisate hls order to the appllcant 7L Power to suspend a license. - (1) The Director of Agrtcultural Markettng may suspend the license if in his opiniorL it is not in public interest that the prlvate market OntinueS to cany on lts functlons, (2, Any order Issued under thls section shall speclfy the delineated market area or areas that the llcensee shall not operate, the duration of suspensl,on and such other detail as may be prescribed. (3) No order of suspension shall remain in force for a period *ceeding flfteen daSrs from tlre date of the order, save in cases wher€ the Dircctor of Agdcultural Marketing commences proceedlngs under section 72 of this Acr 7L Caroclladon of llcense. - (1) The Dlrector of Agricultural Markedng may cancel the Ilcense If, - (a) the licensee has obtained the license fraudulently or by mlsreprcsentation of facts; (b) the licensee or any person acting on his behalf, has violated any of the provlslons of the AcL the rules made thereunder or the bye-laws or tenns and ondlHons of the license; A'HE ASS , EXTRAORDINARY IULY 15, 2022 G) tjre ln concert wtth otler llcensees or other pefsons, wllfully act or abstains from carrying its normal functions and commlts any rcsponsrbilities in its market yard with an rntention of obst'ctin& suspendint or stopplng the marketing of agriculhrral produce in tlle market lrard or derln€ated market anea and rn consequence whereof marketing of any such agrlcultural produce has been obsuucted suspended or stoppeJ; (d) the rrcensee has been adjudrcated as an in'orvent or is an un-discharged lnsolveng (e) the licensee incurs any disqualificatiorl as may be prescribed; or (fl lf the hotder of lrcense is convrctcd of any oftnce under the Actand a pertod ofone year from the date ofsudr convtctron has not rapsed ifthe conviction ls for the first time and a period of three years has not lapsed for every subsequent conviclCon: hovlded that no order cancelling the license shall be made unless the licensee has been given a reasonabt€ opportunlty of belng heard, (2, Any proceeding under thrs section shall be completed within a period of 6lrty days ftom the date of commencement theneof,,
