t (2) It extends to w hole of Assam. (3) It shall come into force at once. 418 THE ASSAM GAZETTE, EXTRAORDINARY, APRIL 4, 2008 \ Amendment of 2. In the principal Act, in section 3, for sub-section (5), section 3. the following shall be substituted, namely :- “(5) No person shall be retained as a member of the Tribunal after he has attained the age of sixty five years or after completion o f a period of 5 years from the date of his re-employment, whichever is earlier : Provided that, - (a) any Government servant appointed as a member of the Tribunal shall retire as such member on attaining the age of 60 years as usual applicable to a servant of the State Government; (b) if such a member, who was a servant of the State Government, retired at the age of 60 years as such member of the Tribunal is re­ employed as a member of the Tribunal, he shall retire on attaining the age of 65 years or shall continue for a period of 5 years from the date of his re-employment, whichever is earlier; (c) the provisions of clauses (a) and (b) shall not be applicable in the case of the Chairman of the Tribunal who shall retire on attaining the age of superannuation as per condition of service governe ?/; y the expe'Tjv • Service Rules of his service cadre,” MOHl).
