When tourism unit operotor moy recover possession : (l) Notwithstonding onything contoined in this Act, o tourism unit operotor sholl be entitled to recover possession of the occommodotion provided by him on obtoining on order from the prescribed outhority to the effect thot ; (o) the lodger hos been guilty of o conduct which constitutes o nuisonce or onnoyonce to ony other lodger; or (b) he lodger hos foiled to poy $e occommodotion chorges ; or (c) the lodger hos foiled to vocote the occommodotion on terminotion of the period of the ogreement in respect thereof : Provided thot before issuing on order under this seaion, the prescribed outhority moy conduct o summory enquiry ond sholl poss on oppropriote order in o summory monner : Provided further thot ony porty oggrieved by on order of the prescribed outhority moy prefer on oppeol before the District Mogistrote of the concerned district who sholl dispose it off in o summory monner. (2) lf he lodger ogoinst whom tre order hos been possed under sub-section (l ) does not comply with the soid order, the prescribed outhority moy toke ossistonce from the police forthe implementotion of the order ond every police officer sholl render the ossistonce for the implementotion of the soid order.
