(1) Subject to such regulations as may be made in the behalf every owner or person having the control of any place already used for disposal of the dead but which is not vested in, or owned by the Municipality or any Board appointed by the State Government for administration of such place, shall submit to the Chief Municipal Executive Officer/ Municipal Executive Officer an application for registration of such place, containing such particulars as maybe specified by the Municipality within a period of three months from the date of commencement of this Act. (2) lf the Chief Municipal Executive Officer/ Municipal Executive Officer is satisfied with the application and the particulars under sub-section (1), he may register such place on such terms and conditions as may be Provided by regulations. (3) The Chief Municipal Executive Officer/ Municipal Executive Officer may, with the approval of the Empowered Standing Committee, provide suitable and convenient place for the disposal of the dead within the municipal area, subject to the provisions of any State law regulating such land use or, in the of any provisions of any State law in this behalf in the municipal area, with the approval of the State Government. (4) No place which has not previously been lawfully used or to registered for the disposal of the dead shall be opened for such disposal except in conformity with the provisions of any State law such land use or in the absence of any provisions of any State law in this behalf in the municipal area, with the approval of State Government. 300.Where the Chief Municipal Executive officer/Municipal Executive Officer is of the opinion that any burning place or burial ground or place for the disposal of the dead has become offensive or dangerous to the health of persons residing in the neighbourhood or for any other reasons to be recorded in writing, he may, with the previous approval of the Empowered Standing Committee, and by notice in writing require the owner or the person in charge of such burning place or burial ground or place for the disposal of the dead, to close such burning place or burial ground or place for the disposal of the dead from such date as may be specified in the notice.
