Subject to such terms and conditions as may be specified by regulations from time to time, the Chief Municipal Executive Officer/ Municipal Executive Officer may, either on his own or through any other agency, authorized by him in this behalf,- (a) erect upon any land or building, or affix to the outside of any building, or to any tree, any shaft or pipe as may appears to him to be necessary for the purpose of ventilating any drain or cesspool, whether vested in the Municipality or not, and (b) examine the condition of a private drain or cesspool within the municipal area in respect of which there is reasonable ground for believing that such private drain or cesspool is in such condition as is prejudicial to health, or is a nuisance, by applying any test other than a test by water under pressure, and if he deems it necessary, by opening the ground.
