(1) Every order ol the Controller passed under this Act, where no appealagainst such order has been preferred under sub-section (1) of section 36, every order of the Appellate Authority on appeal under sub-section (2) of section 36 and every order of the District Judge passed in revision under Section 37 shall be executed by the Controller as if such orders were an order passed by such Controller. (2) The Controller, Appellate Authority shall have the powers ol a civil court when trying a suit under the code of civil procedure in respect of the following matters : (i) Summoning and enforcing the attendance of any person and examining on oath. Revision Award of c0sts. Execution of orders of Controller, Appellate Authority and District Judge. (ii) requiring the discovery and production of any document. receiving evidence on affidavits. issuing commission for the examination of witness or documents. requisitioning any public record or copy thereof from any court or office I any other matter which may be prescribed. (iii) (iv) Penalties Certified copies ol orders and decisions of Controlle( Appellate Authority and Commissioner (v) (vi) CHAPTER - VIII PENALTIES 4'1. (1) lf any person contravenes any of the provisions of thisAct, he shall except as otherwise provided in section '15,be punishable with imprisonment for a term which may extend to two years or with fine which may extend to rupees ten thousand or with both. (2) Whoever fails to comply with any direction made or deemed to have been made underthis Act shall be punishable with imprisonment for a term which may extend to one year or fine which may exlend to rupees ten thousand or with both. Provided that the Controller trying any otfence under thisAct may orderthe whole orany part ofthe fine recovered to be applied to the paymentto any person as compensation tor any loss caused by the offence. 42 CHAPTER - IX MISCELLANEOUS Any person affected by any order of the Controller or any decision of Appellate Authority on appeal or any order of the Commissioner in revision made or passed under this Act shall be entitled to be furnished with a copy thereof duly certified by the Controller, and the Appellate Authority or the Commissioner as the case may be,to be a true copy o payment of such fee as may be prescribed i and such copy shallbe admissible as evidence in any Court of Law to prove the order of the Controller, the decision of the Appellate Authority on appeal or the order of the Commissioner on revision, as the case may be. 63
