Where the landlord recovers possession of any building from the tenant by virtue of an order secured because ol clause (c ) and (e) of sub-section (1) of section 19 and the building is not occupied by the landlord, or by the person for whose benefit the bu;lding is held within three month of the date of vacation of the building by such tenant, or the building having been so occupied is re-letwithin six months of the date of such occupation to any person other than such tenant without the permission ol the Controller, the Conkoller may on the Deposit ol rent determined by the Controller during the tendency of appeal or revision. Entitlement to restoration of possession and compensation by Landlord. Extension of 30 period limited by lease. Appointment 31 of Controllers. Powers of Controller. 5B application of such tenant made within three month of his vacating the building, and giving the landlord an opportunity of being heard, by order directthe landlord to put such tenant in possession of the building or to pay him such compensation as may be fixed by the Controller or both. (1) lf a tenant in possession of any building held on lease for a specilied period intends to extend the period limited by such lease, he may give the landlord at least one month before expiry ol the period limited by lhe lease, a written notice of his intention to do so, and upon the delivery of such nolice, the landlord may renew the lease on lhe terms mutually agreed upon. (2) lf the tenant fails to yacate the building on the termination of lease or as the case may be, on lhe expiry of the period renewed under sub-section (1), the Controller shallon an applicalion bythe landlord pass an order for eviction, which shall be executed as such and may further order that the tenant shall pay to the landlord such amount as may be determined by it as daily compensation. CHAPTER -VII CONTROLLER, APPELLATE AUTHORITY AND COMMISSIONER (1) The State Government may, by notification, in the Official Gazette, appoint as many Controllers as it thinks fit, and define the local limits within which, each Controller shall exercise the powers and perform the functions under this Act subject to provisions of sub-sectlon (2). (2) A person not below the rank of Extra Assistant Commissioner and Executive Magistrate shall be appointed/designated as a Controller in the District. (1) Forthe purpose of any enquiry underthisAct, the Controller may (a) enter and inspect any building at any time betyveen sunrise and sunset or authorize any oflicer subordinate to him lo so enterand inspect any building. 32 59 Provided that no building shall be entered without the consentof theoccupierunless at leasttwentyfourhours previous notice in writing has been given, and (b) by written order require any person to produce lor his inspection such accounts, rent receipts, books or other documenls relevant to the enquiry at such time and at such place as may be specified in the order. (2) The Controller shall have power to summon and enforce the attendance of witnesses and lo compel the production of documents by the same means and, so far as may be, in the same manner as is provided in the case ot a Court by the Code of Civil Procedure (Act No.5 of 1908).
