( 1) The [State J1 Government may, by a rule under the last foregoing section, attach to the breach as any rule under that section any punishment not exceeding imprisonment for a term which may extend to three years , or fine which may extend to five Thousand rupees, or both. *{Substituted by 2005 (Amd) Act (Act no 2 of 2008. s. 7} (2) In cases where the offence is committed after sunset and before sunrise or after preparation for resistance to the execution of any law or any legal process, or where the offender has been previously convicted of a like offence' the convicting court may inflict double the penalty prescribed for such offence.
