Cognizance of offence - No Magistrate shall take cognizance of any offence punishable under section 10, except – (a) upon a report in writing of the facts constituting such offence made by an officer-in-charge of the police station; or (b) upon information received from any person other than an officer-in-charge of the police station, or upon his own knowledge or suspicion, that such offence has been committed.
