Application - (1) The provision of this chapter shall apply to every establishment in which hundred or more workmen are employed on any day of the preceding twelve months: Provided that the Government may, after giving not less than one months’ notice of its intention so to do, by notification, apply the provisions of this chapter to any establishment, employing such number of workmen, less than hundred, as may be specified in the notification. (2) An establishment to which the provisions of this chapter apply, shall continue to be governed by the provisions of this chapter notwithstanding that the number of persons employed therein falls below the number specified under sub-section (1).
