Offences by companies/firms - (1) While applying for license, companies have to nominate a person / persons who are responsible for the complying with the provisions of this Act and Rules made thereunder. (2) In case of violation of any provisions of this Act and Rules made thereunder, the nominated person / persons as well as the company/firm itself, shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly. (3) In case if nominated person/s is/are not working in the company at the time of committing violation, for any reason every person who at the time of the offence, was in-charge of and was responsible for the conduct of the business of the company/firm, as well as the company/firm itself, shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly.
