Offences and Penalties- (1) Any person,- (a) who contravenes the provisions of this Act or rules made there- under; (b) being the holder of license granted under this Act in respect of any private medical care establishment, uses or allows such establishment to be used for illegal purposes in contravention of terms and conditions shall be guilty of an offence and shall- 1[(i) on conviction for a first offence be punishable with a fine which may extend to twenty thousand rupees; and (ii) on conviction for a second or subsequent offence, be punishable with a fine which may extend to forty thousand rupees]; and shall in addition be liable to a fine which may extend to five hundred rupees for every day for which the offence continues after
