(1) Subject to the provisions of this Act, the rent of a tenant shall be payable as follows:-- (i) in case of batai or bighori -- (a) as agreed upon between the tenant and the landholder, (b) in the absence of any such agreement, according to local custom, and (ii) in case of fixed money rent, in instalments proportionate to the revenue instalments payable one month before the dates appointed for the payment of the revenue instalments. (2) Rent, or any instalment thereof, not paid by due date, shall be deemed to be in arrears.
